Terms & Conditions

1. About these terms
These terms and conditions ("Terms") govern the relationship between Jack Lamond ("we", "us", "our") and any individual or business ("you", "the client") that engages us for web design, web development, or related digital services.
By engaging our services, you confirm that you have read, understood, and agree to these Terms.
2. Our services
We provide web design, web development, e-commerce, SEO, branding, and ongoing support services. The specific scope of work for each project will be agreed in writing before work begins, typically via a proposal or statement of work ("SOW").
We reserve the right to decline or discontinue any project that conflicts with our values, capabilities, or availability.
3. Quotes, payment, and timelines
- All quotes are provided in writing and are valid for 30 days unless stated otherwise.
- A deposit of 50% is required before project work begins. The remaining balance is due on completion, prior to the site going live or files being transferred.
- Invoices are due within 14 days of the invoice date. Late payments may incur interest at 8% above the Bank of England base rate, as permitted under the Late Payment of Commercial Debts (Interest) Act 1998.
- Project timelines are estimates. Delays caused by late feedback, missing content, or factors outside our control are not our liability.
- Significant changes to agreed scope may require a revised quote and timeline.
4. Your responsibilities
To enable us to complete your project on time and to a high standard, you agree to:
- Provide all required content (text, images, branding, logins) within agreed timeframes.
- Give clear, timely feedback at agreed review stages.
- Ensure that any content, images, or materials you supply do not infringe third-party intellectual property rights.
- Nominate a single point of contact with authority to approve work on your behalf.
5. Intellectual property
- Upon receipt of full payment, ownership of the final design and code deliverables transfers to you.
- We retain the right to display the completed work in our portfolio and marketing materials unless you request otherwise in writing.
- Any third-party components (fonts, stock images, plugins, frameworks) remain subject to their own licences. We will notify you of any licence requirements that need ongoing payment.
- Work in progress and any deliverables remain our property until payment is received in full.
6. Confidentiality
We treat all client information as confidential and will not disclose it to third parties without your consent, except where required by law. This obligation continues after the project ends.
7. Limitation of liability
- Our total liability to you for any claim arising from our services is limited to the total fees paid by you for the relevant project.
- We are not liable for any indirect, consequential, or loss-of-profit damages, including (but not limited to) loss of revenue, data, or business opportunity.
- We are not responsible for third-party services (hosting providers, payment gateways, plugins) that we have recommended or integrated but do not control.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.
8. Cancellation
- Either party may cancel a project by giving 14 days' written notice.
- If you cancel, you remain liable for all work completed up to the cancellation date, invoiced at our standard day rate. The deposit is non-refundable.
- If we cancel due to your breach of these Terms, the same applies.
9. Complaints
If you are unhappy with our work or service, please contact us at hi@jacklamond.co.uk and we will do our best to resolve the issue promptly and fairly.
10. Governing law
These Terms are governed by the laws of Scotland. Any disputes that cannot be resolved by agreement will be subject to the exclusive jurisdiction of the Scottish courts.
11. Changes to these terms
We may update these Terms from time to time. The version in force at the time you engage us for a project will apply to that project. Updated Terms will be published on this page.
